Last week, an Albemarle County Circuit Court judge ruled that felony possession of a hoax device charges against Mark Ryland Dowdy won't be dropped, in spite of Dowdy's accusations of misconduct against Albemarle County Authorities and a county prosecutor.
Dowdy, 37, of Gordonsville is accused of placing suspicious powder on signs placed near the Klockner-Pentaplast facility in Gordonsville in September 2008. A former employee of Klockner,, Dowdy was charged with five counts of possession of a hoax device, after police said he put a compound which is commonly found in lice killer on five anti-Klockner signs at the corner of Klockner Road and Gordonsville Road in Albemarle County.
In Albemarle County Circuit Court June 16, Circuit Judge Cheryl Higgins denied several motions filed by Dowdy, who is representing himself in court.
Dowdy's motions included a request for more detailed information about his case-in particular, about the exact locations where the compound-laced signs were found. One of the motions questioned whether or not the case against Dowdy could be heard in an Albemarle court since the Klockner plant is technically located in Louisa County.
Higgins ruled that the signs were found in Albemarle County, and that additional evidence would be presented during Dowdy's trial.
In April, Higgins denied Dowdy's motion to place a gag order on the commonwealth's attorney, the fire marshal and the media from talking about the case. In Dowdy's April hearing, he said information was released to the media which would ruin his chances of a fair trial.
Dowdy is currently free on bond, and will appear in Albemarle Circuit for trial June 30. Additionally, Dowdy is scheduled to appear of trial in Louisa County Circuit Court July 10 for a count of possession of a hoax device.
